The Dangers of Improper Maintenance of Nursing Homes in California

When you entrust the care of your loved elder to a nursing home in California, you have the right to expect that the facility they are residing in will be properly maintained, so as to prevent an injury. However, all too often nursing home staff fails to properly monitor the conditions of the facility, which can lead to injuries or even death. In these cases, Personal Injury and Premises Liability claims may be filed against a nursing home for failing to provide a safe residence. By law, nursing homes in California are responsible for repairing hazards on the property grounds, and providing notice of any safety risk, if the problem cannot be fixed immediately.

When an elder is injured on the property of a nursing home, because of the nursing home’s failure to monitor and maintain the property, you may be within your rights to file a claim against the nursing home. Claims that may be filed include:

*Injuries or harm caused by falling objects – when items are improperly stored or stacked within a nursing home, they can result in injury to an elder, should the items fall on the elder hurting them, or causing them to fall.

*Slips and Falls – it is the responsibility of nursing home staff to make sure that the floors are clean, dry, and free of clutter so as to prevent slips and falls which can lead to serious and even life threatening injuries to elders. Wet floors, broken floorboards or stairs, or uneven surfaces are unacceptable in nursing homes, as they have potential to cause serious injury.

*Harm due to insufficient security – California nursing homes are entrusted with the safety of elders who call the facility home. As such it is the responsibility of the nursing home to provide security for its residents. Lack of proper security, which allows a predator to attack, or assault an elder living within the nursing home, is grounds for filing a lawsuit in California.
